The need for an external security officer arises from the high requirements of the Telecommunications Act for data security and the protection of personal data.
As an external security officer, we assume responsibility for the security of your company with regard to § 166 TKG (formerly § 109 TKG). We ensure that your company fulfils the requirements and thus avoids possible fines or claims for damages.
Our tasks as an external safety officer include:
- First point of contact for cooperation with authorities (BNetzA) and other parties involved
- Monitoring the security concept
- Identification of security risks and initiation of measures to minimise risks
- Reporting to the management during BNetzA monitoring audits

Background and details
The legislator defines in TKG §166 that the Bundesnetzagentur publishes a catalogue of security requirements that must be implemented. The current catalogue, dated 29.04.2020 (version 2.0), still refers to the old legislation (TKG before 01.12.2021). This is creating a lack of clarity in the regulations, which will hopefully be closed by a new publication this year (2022). The tasks of the security officer are described in abstract terms in this catalogue (see page 36, section 5.1.8):
5.1.8 Appointment of the security officer: The designation of the security officer is not a direct component of the security concept. However, the designation, like the creation of the concept, must take place when the business or service is started. In this respect, there is both a temporal and contextual relation between these obligations. The security officer should be given certain coordination, control and specialist tasks. The security officer or the designated representative should also be the contact person of the Federal Network Agency. In accordance with the performance of this task, the agency should maintain the necessary specialist knowledge and an understanding of company processes. The agency’s knowledge of developments in IT security, processes in the company and the legal framework must be kept up to date. The prerequisites for direct contact with the company management must be created.Team
